TERMS AND CONDITIONS

 

1. PURPOSE

The purpose of these terms and conditions (hereinafter the “General Conditions”) is to regulate the online sale and purchase (the “Service”) of furniture, products and decoration items (referred to collectively as the “Products” and individually as the “Product”) put on sale by BEAN HOME S.L. through its website www.beanhome.es.

The General Conditions supplement and develop, insofar as they are not incompatible with, the terms and conditions established in each of the electronic purchase orders made by the customers of BEANHOME and the terms and conditions established in each of the confirmations by BEANHOME of each purchase order.

 

2. ACCESSION TO THE GENERAL CONDITIONS

You are advised to read the General Conditions carefully, since by completing and submitting the purchase order, you are considered to accept fully and without reservation each and all of these General Conditions. Accordingly, before a purchase order can be submitted, you will be required to accept the General Conditions and the Privacy Policy of BEANHOME electronically. However, any modification to the clauses of the General Conditions or the Privacy Policy made after the date of submitting a specific purchase order for a product will not be applicable to you for that purchase. If you do not accept the General Conditions and/or the Privacy Policy, you must not use the service.

 

3. USE OF THE WEBSITE

By using and placing orders through this website, you undertake to:

  1. Use this website exclusively to make legally valid consultations or orders.
  2. Not place any false or fraudulent order. If it may reasonably be considered that an order of this nature has been made, we will be authorised to cancel it and inform the competent authorities.
  3. The e-mail, postal address and/or other contact details that you provide must be true and accurate. You consent to our use of that information to contact you, if necessary (see our Privacy Policy). If you do not provide all the information we need, we will be unable to process your order.

If, on receiving confirmation of your order, you detect an error in the details you entered in the purchase order, contact BEANHOME immediately to correct the error, sending an e-mail to ilove@beanhome.es.

 

4. AVAILABILITY OF THE SERVICE

The items offered on this website are only available for delivery within the Spanish mainland and Balearic Islands (except Formentera).

You may place an order from the Canary Islands, Ceuta, Melilla or another country through this website, but in this case bear in mind that we only offer deliveries to addresses within the Spanish mainland and Balearic Islands (except Formentera).

 

5. HOW TO SHOP

We hope your experience in the Beanhome online store will be pleasant and simple. Our online store has been designed thinking of your comfort, so we have added a simple browsing menu.

When you place an order through this website, you declare that you are over 18 and have legal capacity to conclude contracts.

To make an order, follow the online shopping procedure, inserting or checking the information requested at each stage. You will have an opportunity to change the details of your order before payment.

  • Select the products you wish to buy and add them to your basket.
  • Select “Process Order” and complete all the information indicated in the fields (including your name, telephone number and e-mail).
  • Indicate an address for delivery within Spain, only on the mainland or the Balearic Islands (except Formentera).
  • Select the payment option that best suits you and type in the details requested. Then click on “Make Payment”.
  • You will then receive an e-mail confirming your order. At that point, the contract of sale of the Product is considered concluded.
  • You will receive updates on the situation of your order in subsequent e-mails.
  • Finally, you will receive an e-mail indicating the delivery date.

 

6. AVAILABILITY OF THE PRODUCTS

All orders are subject to availability. If a problem is encountered for supplying or customising products as requested, or if an item is out of stock, BEANHOME will refund any amount that you have paid.

 

7. DELIVERY INFORMATION

Unless the products have been customised, or in unforeseen or extraordinary circumstances, the delivery time of our products is indicated in each purchase.

The order will be sent by carrier to the delivery address indicated when the purchase is made. The transport firm will get in touch with the customer as follows:

  • It will send a first notice of delivery by e-mail.
  • It will then call you to arrange a delivery date.
  • It will send an e-mail to confirm the arranged delivery date.
  • The carrier will then telephone on the delivery date when they are on the way.

If for any reason we are unable to deliver on the specified date, we will let you know, giving you the option of continuing with the purchase, setting a new delivery date, or cancelling your order with a full refund of the price paid.

For the purpose of these Conditions, we will consider that the “delivery” has been made or the order “delivered” when you, the customer -or a third party indicated by you- takes physical possession of the products, signing the delivery note.

If the purchased product requires assembly, this is included in the price. The furniture will be assembled by the carriers. If you do not wish to unpack or assemble the product, mark the space on the delivery note where it says: “I waive unpacking and assembly, assuming that the product is in perfect condition”.

When the product has been unpacked and assembled, do not discard the packaging. In order to return the product, if necessary, this must be done using all the original packaging and sending the product to BEANHOME in perfect condition and perfectly packaged.

If you do not wish to keep the packaging, indicate this on the carrier’s delivery note, marking: “the recipient authorises the carrier to withdraw the packaging”.

 

8. DELIVERY IMPOSSIBLE FOR REASONS ATTRIBUTABLE TO CUSTOMER

If we are unable to deliver a product after arranging and confirming the delivery date with you, you will be charged for a second delivery. BEAN HOME S.L. will indicate the cost and how to make payment before the second delivery is made.

If it is not possible to make the delivery owing to problems of accessibility, the reason will be indicated on the delivery note and you will be responsible for finding and bearing the cost of a different delivery option. We recommend that you check the measurements of all packaging, which are stated in the description of each product.

Disclaimer in delivery. BEANHOME will be released from its obligation to deliver as per the General Conditions in the following cases:

  • Total or partial nonpayment by the Customer.
  • Omission or inaccuracy of information to be supplied by the Customer in the purchase order, pursuant to the General Conditions.

In the event of force majeure, the obligation to deliver the Product will be suspended and BEANHOME will contact you, undertaking to deliver the Product at the earliest opportunity after the end of the situation of force majeure.

 

9. TRANSFER OF RISK AND OWNERSHIP

The risks of the Products are transferred to the Customer as from the time of delivery. The Customer will acquire ownership of the Products when BEANHOME receives full payment of the amounts owed in connection therewith and they have been delivered.

 

10. PRICE

All prices are stated in euros and include VAT, delivery and assembly.

Prices are subject to change at any time, but changes will not affect orders that have already been confirmed.

 

11. PAYMENT OPTIONS

When you select all the items you wish to buy, they will be added to your basket and the next step will be to process the order and make payment. To do this, follow the steps of the purchase process, completing or checking the information requested at each stage.

HOW CAN I PAY FOR MY PURCHASE?

BEAN HOME S.L. accepts the following methods of payment. Choose whichever best suits your needs.

  1. Credit or debit card
    • Visa
    • MasterCard
    • Maestro
  2. Bank transfer.
  3. Pay by instalments with Pepper.

IS PAYMENT SECURE AT THE BEANHOME ONLINE STORE?

At BEANHOME we take the security of your personal and bank details very seriously.

Pay securely with your bank card at the Beanhome online store using the TLS 1.2 security protocol.

Having a TLS 1.2 (Transport Layer Security) Certificate means our website has been verified as authentic and that its purpose is legitimate.

Your personal data and your payment details are completely safe, which means that you enter your card details directly into the payment gateways of the financial institutions (Redsys or Pepper).

These financial institutions have PCI DSS Certification (Payment Card Industry Data Security Standards), which requires strict control in the processing of our customers’ financial data, complying with the international security standards developed by VISA and MasterCard.

We thus certify that the details of your card are encrypted, with a high level of security, processed through a secure connection and that your card details cannot be read by third parties.

The financial institution only accepts SEC (Safe Electronic Commerce) transactions with the international protocol 3D Secure (triple authentication of the cardholder).

This is the new method of payment developed by Visa and MasterCard that allows you to make safe payments on internet and authenticates the buyer as the legitimate holder of the card being used.

You can only purchase if you enter a security code sent to your mobile phone, which will authorise the purchase you are making at that precise moment. If you do not enter that code, you will not be able to complete the purchase with the card.

The closed padlock icon next to the URL of the web page and the “https” at the beginning of the URL indicate that the server of our website is protected.

 

WHY IS MY CARD REJECTED?

Your card might be rejected for one of the following reasons:

  • The card is not enabled for payments in Safe Electronic Trade (SEC). At Beanhome payments are made in a financial institution safe environment that only accepts CES transactions with the international protocol 3D Secure. The payment gateway will check that the credit card is enabled for CES and will ask the issuing bank for authorisation with a personal authentication code. The transaction will only be completed if the bank issuing the card confirms the authentication code. Check with your bank that your card is CES-enabled.
  • The card may have expired. Check that the expiry date on your card has not passed.
  • You may have reached the spending limit established for your card. Check with your bank that the limit established for purchases has not been exceeded.
  • One of the details you have entered might be wrong. Check that you have correctly completed all the necessary fields.

 

PAYMENT BY CREDIT CARD

If you choose to pay by Credit Card, you will follow the steps indicated below:

  • You will be redirected to a Safe Payment web page.
  • Enter the name of the Holder, Number and Expiry Date of the card.
  • If you pay by Visa or Mastercard, enter the verification code sent to your mobile.
  • When the transaction has been authorised, click on continue and you will automatically return to beanhome.es to view the summary of your order.

 

PAYMENT BY BANK TRANSFER

If you choose to pay by Bank Transfer, you will receive an e-mail with the necessary information for the transfer.

You must transfer the amount of payment to the current account of BEAN HOME S.L. within 3 business days or your order will be cancelled.

The order will be finally validated when we receive the transfer. We will then send you a confirmation e-mail.

IMPORTANT: If you pay by transfer, the delivery times will start to run once the transfer has been received and cleared.

 

PAY BY INSTALMENTS WITH PEPPER MONEY

Pepper Money Pepper Money is a financial institutions that has been innovating for over 15 years to offer consumers the best financing.

Pepper Money is a system of financing that is just as fast, simple and safe as shopping with a bank card. Contracting is entirely online, with no additional paperwork. All you have to do is fill in a form with your details; your request is assessed and answered immediately.

How does the application process work? 

Before paying for your purchase, you can simulate your financing for different numbers of instalments to see how much your order would come to and decide whether or not you want to finance it.

If you choose the Pepper Money option as your form of payment, you just need to follow these two steps:

  1. Choose 3, 6, 9 or 12 instalments and the amount of the fixed monthly instalment will be calculated automatically.
  2. Fill in a brief form with your personal and bank details and in just a few seconds you will know whether your financing has been accepted.

Enter your credit or debit card details and the first instalment will be charged automatically. Subsequent instalments will be charged to the same card.

Electronic signature is available for the contract, so you can sign by entering a PIN sent to your mobile phone.

Pepper Money will send you an e-mail with a summary of the amount of each of the monthly instalments. You will also be given instructions on how to access your control panel, where you can consult all the information on your financing and prepay instalments or even the total purchase if you like, automatically reducing the interest payable.

How are the instalments paid?

After paying the first instalment on completing the application process, subsequent instalments will be charged automatically to your card every month. Remember that the instalments are paid in fixed, equal amounts, with no charges other than those indicated in the purchase process. Pepper Money will notify you by e-mail before charging each instalment. You can also see this information in your Client Area.

Financing is available for purchases of a minimum of twenty euros (€20). If your purchase exceeds six thousand euros (€6000), the excess must be paid together with the first instalment.

After selecting the form of payment and clicking on “Pay”, you must confirm that you are the lawful holder of that form of payment.

The credit card payment service is provided directly by the bank or credit card institution, as the case may be. The corresponding amount will be charged to your card immediately on confirmation of the order.

Debit and credit cards are subject to checks and authorisations by the issuing institution. If that institution does not authorise payment, BEANHOME will not accept any liability for delayed or non-delivery and will be unable to enter into a contract with you.

Payment through the Financing Entity is subject to the conditions and approval by that entity, as indicated in the link FINANCING. Bean Home SL does not provide financing services, so any financing arrangement between you and the financing entity to buy the Products is made directly between you and the financing entity, without any participation or obligation of Bean Home S.L.

 

12. PRODUCT INFORMATION

The descriptions, photographs, graphic or iconographic representations and videos on the Products offered by BEANHOME on its website, and the trade names, trademarks or distinguishing marks of whatsoever nature contained on the website are intended to provide the most possible information. However, Users must bear in mind that they are intended purely for guidance and are not exhaustive.

We select and manufacture top quality materials and products, but the natural features of the materials are inevitable and must be accepted as part of the individual appearance of the Product.

BEANHOME reserves the right to decide at any time what Products are to be offered to Users through the website.

BEANHOME also reserves the right to discontinue access to any of the Products offered on the website at any time and without notice.

 

13. RETURNS POLICY

Returns are subject to the provisions of Legislative Royal Decree 1/2007 of 16 November, approving the recast User and Consumer Defence Act and other supplementary laws and regulations.

13.1. Cooling-off period or right of withdrawal
If you are shopping as a Consumer or User, you are entitled to withdraw from the purchase contract within 14 business days without justification.

The cooling-off period will expire 14 business days after you, as the Customer, or a third party designated by you other than the carrier, acquired material possession of the Products or, if the items included in the order are delivered separately, 14 business days after the date on which you, or a third party designated by you other than the carrier, acquired material possession of the last item delivered.

To exercise this right of withdrawal, you must notify BEANHOME, clearly and unequivocally stating your decision to withdraw from the contract. For this notification to be valid, it must be sent by a means allowing proof of receipt by BEANHOME, the time of sending, the address to which it was sent and the time it was received by BEANHOME. This notification must be sent to:

To comply with the cooling-off period, it is sufficient for your notification announcing exercise of your right of withdrawal to be sent before the end of that time.

In any case, it is your responsibility to prove that you exercised your right of withdrawal in due time and form.

Products cannot be returned if they have been used.

Returns of mattresses and futons will not be accepted if the plastic protection or cover has been opened.

13.2. Consequences of withdrawal

If you notify BEANHOME of your decision to withdraw after receiving the Product, you must return the Product within no more than 14 calendar days following notification to BEANHOME of the decision to withdraw from the contract.

The Product must be returned subject to the following:

  • The Product must be exactly as it was when received.
  • It must not have been used other than merely opening the packaging.
  • It must be in the same state as it was in when delivered and have suffered no damage.
  • It must be packaged using all the original packaging and include all the documents sent with the Product and a printed copy of the confirmation and/or invoice originally sent to you by BEANHOME.

The cost of handling and transport for the return are payable by the customer.

BEANHOME will reimburse the price of the purchase once we have received the Product and checked that it is in perfect condition. The refund will be made within no more than 30 days using the same form of payment as that used by the customer.

If you exercise your right of withdrawal before the Product is delivered and before receiving the first notice “The order is being processed”, there will be no cost so BEANHOME will refund the total amount of the purchase. If the right of withdrawal is exercised after the first notice “The order is being processed”, you must pay the costs incurred. Those costs will depend on the Product and the current stage of the delivery process. BEANHOME will duly inform you of that cost by e-mail. That cost will be deducted from the refund of the purchase price, which will be made made within no more than 30 calendar days using the same form of payment as that used by the customer.

If any damage attributable to the Customer is detected in the Products returned, thus reducing the value of the item, you must indemnify BEANHOME for the amount corresponding to such damage, which will be deducted by BEANHOME from the refund payable as a result of your withdrawal from the purchase contract.

13.3. Exceptions for withdrawal
No withdrawal is possible in respect of Products that have been manufactured according to customer specifications or customised in any way by the buyer.

13.4. Returning faulty products
Customers express their acceptance of the perfect condition of the product when it is delivered, by signing the delivery note. If the product is damaged or faulty, this will be stated on the delivery note and the carrier will withdraw the Product subject to assessment by BEANHOME. BEANHOME will contact you to indicte the new delivery time. In this case, only the first delivery will be invoiced and BEANHOME will bear the costs of the return and second delivery.

 

14. GUARANTEES

Legislative Royal Decree 1/2007 of 16 November approving the recast User and Consumer Defence Act and other supplementary laws and regulations. In any incidents justifying use of the guarantee, it will be possible to opt for repair, replacement, reduction of price or refund, on the terms established in law.

BEANHOME guarantees the Products it sells through this website, on the terms established in law for each kind of product, accepting liability for any non-conformity that appears within two years of delivery of the Product, provided it was assembled by professional installers using adequate material. BEANHOME does not accept liability for incidents caused by mishandling of the materials supplied.

The Products are deemed to conform with the contract provided they:

(1) Conform to the description given by BEANHOME and have the qualities indicated on this website.
(2) Are suitable for the use that would normally be made of products of the same nature.
(3) Presenten la calidad y prestaciones habituales de un producto del mismo tipo que sean fundadamente esperables.

In this regard, if any of the Products do not conform to the contract, you should inform us clearly and unequivocally. For this notification to be valid, it must be sent by a means allowing proof of receipt by BEANHOME, the time of sending, the address to which it was sent and the time it was received by BEANHOME. The Products we manufacture and sell often present the characteristics of the natural materials used in their manufacturing. These characteristics, such as variation in the grain, texture, knots and colour are not considered faults or defects. On the contrary, you should expect and appreciate them. We select only top quality materials for our Products, but the natural characteristics are inevitable and should be accepted as part of the individual appearance of the Product.

 

15. MODIFICATION

These General Conditions may be modified by BEANHOME. Customers are responsible for reading them regularly since the General Conditions in place at the time of access to the BEANHOME website or entering into a contract of sale will be applicable.

 

16. APPLICABLE LAW

These General Conditions are subject to and governed by the laws of Spain and any disputes will be submitted to Spanish jurisdiction.

 

17. BROWSER SECURITY

The BEANHOME online store has been designed to work best with the latest versions of Internet Explorer, Firefox and Safari.
